- Submission and Quotation Process
1.1 Upon submitting the Online Antenuptial Contract (ANC) form and all necessary supporting documents, clients will receive a written quotation within 1 business day.
1.2 The cost of drafting the ANC depends on the complexity of the contract and the time spent drafting.
1.3 No ANC will be drafted before the full quoted amount is paid.
1.4 Clients must ensure that the marriage date are at least 7 days from the date of form submission. ANC requests for marriages within 7 days will not be processed.
- Payment and Drafting Process
2.1 After receiving the quotation, clients must accept the terms and pay the full quoted fee to proceed with the drafting of the ANC.
2.2 Upon receipt of payment, a draft ANC will be sent to the clients via email for review within 3 business days.
2.3 A FREE 30-minute Microsoft Teams consultation may be arranged to discuss or clarify any aspects of the ANC.
- Revisions
3.1 Clients are entitled to two free revisions of the draft ANC.
3.2 Any additional revisions beyond the two included revisions, particularly if errors or omissions are due to incorrect information provided by the client, will be charged at an hourly rate of R800 per hour.
3.3 Additional payments for revisions must be made before the ANC can be registered with the Deeds Office. Failure to make these payments will result in the ANC not being registered.
- Signing and Registration
4.1 Once the final draft is approved, an appointment will be scheduled at our Brackenfell office for the parties to sign the ANC before a Notary Public.
4.2 After signing the ANC, our Notary Public will issue a certificate, which must be handed to the marriage officer. The certificate will confirm that the parties have entered an antenuptial contract and that the marriage will be out of community of property.
4.3 The signed ANC will then be lodged with the Cape Town Deeds Office for registration.
4.4 The registration process typically takes 8 working days, and delivery of the registered ANC may take between 1 to 3 months. Clients will be informed once the registered ANC is available for collection or courier delivery.
- Fees
5.1 The quoted fee will include the Deeds Office and Lodgment Fees.
5.2 A courier fee of R350 will be charged for the delivery of the registered ANC to the client.
5.3 Fees for additional revisions beyond the two free revisions are charged at an hourly rate of R800 per hour.
5.4 No refunds will be provided once the ANC has been drafted, even if it is not signed or registered.
- Liability
6.1 AD LEWIS ATTORNEYS INC T/A ADL ATTORNEYS INC (“ADL”) is not liable for any delays or issues caused by incomplete, incorrect, or missing information provided by the client.
6.2 Clients are responsible for ensuring that the ANC is signed before their marriage date. The firm is not responsible for any invalidation of the ANC due to the client’s failure to sign on time.
6.3 ADL refutes all liability for the validity of the ANC if it is not signed before the marriage date.
6.4 The firm will not accept any liability for errors, omissions, or delays resulting from the client’s failure to provide accurate contact details or necessary information.
- Refund Policy
7.1 Once the drafting process has commenced and an ANC has been prepared, no refunds will be issued, regardless of whether the contract is signed or registered.
- Service Area
8.1 The online ANC submission service is limited to clients who are able to visit our Brackenfell office to sign the final contract prior to their marriage date.
- Process Overview

- Confidentiality
10.1 All information provided by the client will be treated as confidential and will not be disclosed to third parties, unless required by law or with the client’s explicit consent.
- Client Responsibility
11.1 Clients are responsible for providing accurate and complete information to facilitate the ANC drafting process. Any errors or omissions due to client information may result in delays or additional charges.
11.2 Clients must ensure that the ANC is signed before the marriage date. Failure to do so will invalidate the ANC, and ADL will not be liable for any consequences of such failure.
- Limitation of Liability
12.1 ADL’s liability will be limited to the amount paid by the client for the ANC drafting and registration services. The firm will not be responsible for any indirect or consequential losses.

The firm is not liable for any issues arising from incorrect contact information provided by the client, which may prevent necessary communication regarding the ANC or its registration.
No ANC will be drafted or registered without full payment of the quoted fees. Once a contract has been drafted, no refunds will be provided, even if the contract is not signed or registered.
Our online ANC service is only available to clients who can visit our Brackenfell office to sign the final ANC before the marriage date. We disclaim all liability for any client errors, omissions, or delays in providing necessary information or attending appointments.
