Marketing and Selling of Properties
What is the alternative to a traditional estate agency sale and private selling by owners?
The alternative is selling through your attorney as your realtor, a concept known as Attorneys Selling Properties (Attorney Realtors).
Attorneys allowed to market and sell properties for their clients and are exempt from the Property Practitioners Act. Instead, Attorneys are regulated by the Legal Practice Council, which oversees attorneys and protects the public in legal matters.
Fixed Fee Structure
At ADL Attorneys Inc., we offer a fixed fee arrangement for the entire process, from marketing to selling your property.
We charge a low, all-inclusive, fixed fee instead of a traditional estate agent commission, which can reach up to 7%.
Our Vision
Our vision is to provide sellers and buyers of immovable property with the comfort and security of their own attorney.
We aim to facilitate the potentially highest value transaction our clients will ever enter into while saving them money.
Every property transaction deserves to be efficiently and professionally handled by your attorney, ensuring no unexpected or unpleasant surprises halfway through.
Why Use an Attorney to Sell Your Property?
Expertise and Qualifications:
An Attorney Realtor possesses all the necessary skills, expertise, and qualifications to successfully complete a property transaction.
An Attorney Realtor well-equipped to understand and deal with additional concerns such as tax consequences.
Navigating Complex Legal Environments:
Attorney Realtors are specifically trained to navigate the increasingly complex legal landscape surrounding property transactions, including the FIC Act, National Credit Act, Consumer Protection Act, Alienation of Land Act, and more.
Customized Contracts:
Attorney Realtors draft customized sales contracts tailored to the specific needs of their clients, unlike the one-size-fits-all contracts often used, which may not address important aspects of your transaction.
Comprehensive Property Service:
Our team of creative and innovative attorneys and conveyancers combines their skills, expertise, and the latest technology to provide a comprehensive property service.
We assist clients with educated choices before listing their properties, ranging from capital gains tax information and correct transactional parties to listing properties on the largest online property portals and networking systems.
We ensure property sellers receive offers from cash or prequalified home buyers and assist with the home loan application process.
We also handle complex transactions such as deceased estate property sales, sales with VAT implications, and transactions involving trusts, companies, close corporations, and more.
How It Works
More Money for Your Property:
By entrusting your attorney with the marketing and sale of your property, you will pay significantly less commission than with traditional selling methods. This reduction in overheads and time wastage allows us to charge a flat rate for property sales.
Lower Commission Rates:
As Attorney Realtors we offer lower commission rates compared to the traditional estate agent commission, which can reach up to 7%.
Early Involvement:
It is advisable to consult your conveyancing attorney as soon as you consider selling your property.
A specialised property attorney (aka a Conveyancer) can assist in ensuring you have all necessary documentation and up-to-date information to advertise your property correctly. This includes drafting a contract that reflects the intentions of both parties and contains full and correct information about the property and other relevant factors.
Advertising and Buyer Information:
Properties are advertised on popular property websites such as property24.com and privateproperty as well as our social media pages and website.
When buyers inquire about the property, it is important to obtain information about their needs, requirements, and financial situation.
Areas We Serve:
We currently serve the following areas:

Property Transfer: Seller’s Decision who to appoint as the Transferring Attorney / Conveyancer
Although we can assist a seller with the transfer of their property, this decision ultimately remains with the seller.
It is important to note that:
The seller chooses the conveyancer. An estate agent may not pressurise a seller into selecting a particular attorney, conveyancer or firm of attorneys, merely because the estate agent has a good relationship with them.
Estate agents are sometimes of the view that certain conveyancers are able to expedite transfers more than others. This personal view does not justify a seller being influenced to utilise or refrain from utilising the services of any particular attorney or conveyancer.
NB: Sellers carry more risk than buyers if things go wrong.
Buyer Option: The buyer can however negotiate with the Seller to appoint his/her own conveyancer, only the Seller has the choice here to accept or not.
Obligations to the Client
Attorneys have a clear duty to their clients, providing a high degree of privacy and confidentiality.
An Attorney Realtor represents you in buying or selling a house and is not incentivized by commission, ensuring unbiased representation.
Only attorneys can give legal advice, making an attorney better equipped to guide you through the legal aspects of your property transaction.
